Welcome to Beam Agency LLC (“Beam,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, beamagency.com (the “Site”), and any services provided by Beam Agency LLC.

By accessing or using our Site or services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

1. About Beam Agency LLC

Beam Agency LLC is a creative placement and marketing services agency. We connect businesses with vetted creative professionals and may also provide consulting, project coordination, and marketing support services.

Beam Agency LLC does not guarantee employment, permanent placement, or specific business outcomes.

2. Use of Website

You agree to use this Site only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use of the Site.

You may not:

  • Use the Site for fraudulent or misleading purposes
  • Attempt to gain unauthorized access to the Site or its systems
  • Copy, reproduce, or redistribute Site content without permission

3. Services & Engagements

All services provided by Beam are subject to:

  • A written proposal, agreement, or contract
  • Defined scope, timelines, and fees
  • Acceptance by both parties

Verbal agreements are not binding unless confirmed in writing.

4. Independent Contractors & Talent Placement

Beam Agency LLC:

  • Sources, vets, and introduces independent contractors or creative professionals
  • Does not employ these contractors unless explicitly stated in writing
  • Is not responsible for the performance, actions, or omissions of independent contractors

Clients are responsible for:

  • Final hiring decisions
  • Compliance with all applicable labor, tax, and employment laws
  • Direct payment to contractors unless otherwise specified in writing

5. Fees & Payments

Fees for Beam services are outlined in written proposals or agreements.

Unless otherwise stated:

  • Payments are due according to the agreed schedule
  • Late payments may be subject to late fees or suspension of services
  • All fees are non-refundable once services have begun

6. Intellectual Property

All content on this Site — including text, graphics, logos, images, and design — is the property of Beam Agency LLC or its licensors and is protected by intellectual property laws.

You may not use Beam’s branding, content, or materials without prior written consent.

7. Client-Provided Materials

Clients represent that they have the legal right to use any materials provided to Beam (logos, images, copy, data, etc.).

Beam is not responsible for copyright, trademark, or licensing violations related to client-provided materials.

8. SMS Communications & Messaging Program

After interacting with Beam Agency LLC through a discovery call booking, scorecard submission, or sales-partner-facilitated inquiry, you may receive a separate email invitation to opt in to receive SMS text messages from Beam Agency LLC. SMS participation is voluntary and completely separate from your service interaction with Beam. By clicking the affirmative confirmation link in that invitation email, you agree to receive SMS text messages from Beam Agency LLC in accordance with the terms described in this section.

a. Program Description

Beam Agency LLC operates a transactional SMS messaging program to communicate with prospects and clients regarding:

  • Scheduled discovery calls and appointment confirmations
  • Appointment reminders prior to scheduled calls
  • Follow-up communications tied to a specific inquiry, scorecard submission, or scheduled appointment
  • Service-related notifications and updates

Messages sent through this program are transactional in nature and are tied to a specific scheduled appointment or inquiry initiated by the recipient. This program does not include promotional or marketing content.

b. Message Frequency

Message frequency varies based on your interactions with Beam Agency LLC. You can expect up to 3 messages per scheduled appointment or inquiry.

c. Message and Data Rates

Message and data rates may apply depending on your mobile carrier and plan. Beam Agency LLC is not responsible for any fees charged by your wireless carrier for sending or receiving SMS messages.

d. Opt-In Consent

Participation in our SMS program is voluntary and is collected through a dedicated, separate opt-in process. You will not be enrolled in our SMS program by:

  • Providing your phone number on any booking form, scorecard, or other web form
  • Submitting any inquiry, scorecard, or appointment booking
  • Having information submitted on your behalf by a Beam Agency LLC sales partner

To opt in to SMS messages, you must complete the following affirmative action:

  1. Receive a dedicated email invitation from Beam Agency LLC inviting you to opt in to SMS. This invitation will arrive separately from any service-related email such as appointment confirmations.
  2. Click the “Confirm SMS updates” link in that email, which will take you to a dedicated confirmation page on Beam’s website.
  3. On that confirmation page, click the “Yes, I want SMS updates” button to affirmatively opt in. Clicking “No thanks — email only” or taking no action declines the SMS invitation.

Your opt-in status is recorded in Beam Agency LLC’s customer management system. No SMS will be sent to your phone number unless you have completed this affirmative opt-in process and your opt-in status is recorded as confirmed. Submission of a phone number alone does not constitute consent and will never result in SMS messages.

e. Opt-Out Instructions

You can opt out of receiving SMS messages from Beam Agency LLC at any time by replying STOP to any message you receive. After replying STOP, you will receive one confirmation message acknowledging the opt-out, and no further SMS messages will be sent unless you re-opt in.

g. Eligibility

You must be 18 years of age or older to opt in to receive SMS messages from Beam Agency LLC.

h. Carrier Liability

Mobile carriers (including but not limited to AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, and other carriers) are not liable for delayed or undelivered SMS messages.

i. Privacy & Data Handling

Information collected through our SMS program is governed by our Privacy Policy. No mobile information, phone numbers, or SMS opt-in data will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors providing support services (such as message delivery aggregators) is permitted only as necessary to deliver the SMS program.

j. Changes to the SMS Program

Beam Agency LLC reserves the right to modify, suspend, or discontinue the SMS messaging program at any time without prior notice. Material changes affecting your rights will be reflected in updates to these Terms and our Privacy Policy.

9. No Guarantees

Beam Agency LLC does not guarantee:

  • Specific business results
  • Revenue growth
  • Leads, conversions, or performance metrics
  • Contractor availability or outcomes

All services are provided on a best-effort basis.

10. Limitation of Liability

To the fullest extent permitted by law, Beam Agency LLC shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Contractor actions or third-party services
  • Delayed or undelivered SMS messages caused by mobile carriers or third-party service providers

Our total liability shall not exceed the amount paid to Beam for the services giving rise to the claim.

11. Third-Party Tools & Links

Our Site or services may reference or link to third-party tools, platforms, or websites. Beam is not responsible for the content, policies, or practices of third parties.

Use of third-party services is at your own risk.

12. Termination

We reserve the right to terminate or suspend access to the Site or services at our discretion, including for violations of these Terms or non-payment.

13. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

Any legal action must be brought in the appropriate courts located in Washington State.

14. Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the Site constitutes acceptance of the updated Terms.
